Developers Challenging Growth Measure

A North Livermore developer has filed suit to overturn a recent growth measure passed by voters in November.

Developers in Alameda County are preparing to challenge a recent measure passed during the November elections that would limit urban growth in the Tri-Valley area. Shea Homes, a North Livermore developer, filed suit with the Alameda Country Superior Court to overturn Measure D, which was approved by 56 percent of the voters. Measure D overturned an earlier initiative which allowed developers to proceed with plans to build housing for a community of 30,000 people. Some experts say it is unlikely that the developers will succeed because, in the past, courts have respected the rights of citizens to zone their own communities. Environmental groups, led by the Sierra Club, have joined the county in defending the measure. The case could go to trial this fall.
