A federal judge in Philadelphia upheld the Religious Land Use and Institutionalized Persons Act (RLUIPA) which exempts religious groups from most local zoning rules unless a community can demonstrate a "compelling" need for the zoning restrictions.
"In the first decision of its kind, a federal judge in Philadelphia on Wednesday upheld the constitutionality of the Religious Land Use and Institutionalized Persons Act, which effectively exempts religious groups from most local zoning rules. A Delaware County, Pa., church fought a zoning rule that prevented it from meeting in a commercial zone, saying it violated the First Amendment rights of the church and its congregation."
