Supreme Court heard arguments in two significant cases that question the authority of the EPA and the structure of federal regulation under the Clean Air Act.

"The cases pit the trucking industry against the Environmental Protection Agency over the issue of whether the EPA unconstitutionally acted like a legislature when it setnew, tougher emissions standards for certain air pollutants on the basis of public health considerations, without considering economic costs or other factors." The outcome may mean that EPA would be required to employ cost-benefit analysis in setting standards for emissions.
