City doesn't want towers to be an aethetic nuisance, but can it require a conditional use permit for every tower?

Lake Elsinore city officials, who recently mandated that a tower should look like a pine tree, now want to create an ordinance to regulate the location and looks of cellular and antenna towers in the city. At issue is whether the city can legally require a conditional use permit for every cell tower.
