Housing Definitions

Our department received a development request to construct a triplex containing four-bedroom dwelling units but our zoning ordinance definition of "family" only allows a traditional family or three unrelated individuals living as a residential unit. The development is targeted at student housing but the original family definition was created to specifically hinder over-occupancy of large 1930's housing close to the school boundary. Development is located in a Form Based Zoning District which helps with differentiating density for legal challenge. We are currently looking for additional use definition examples regarding this issue and we have checked APA PAS Reports 491/492 & 521/522. Thanks for any assistance.

Definition of family

The City of LA also has a definition of family in its zoning code that is consistent with Federal and State Fair Housing Law.
