Deviation as Way of Non-Conforming Gas Station to Expand

Has anyone heard of a situation where a deviation through a process similar to a PUD has been used to allow a non-conforming gas station to expand. The deviation would be to deal with setback standards which have changed since the the gas station's construction and it is currently unable to meet. Since traditional non-conforming use language would not allow this business to exand, could a deviation be used?
